Description
BAILEY BROWN, Circuit Judge. Luis Mari was convicted of possessing thirty-three kilograms of cocaine with the intent to distribute in violation of 21 U.S.C. § 841(a)(1). He appeals this conviction, claiming only that the district court committed reversible error by instructing the jury that Mari's guilty knowledge of possession of cocaine in the truck he drove could be found, inter alia, through the theory of deliberate ignorance. In support of this contention, Mari argues that the proof introduced at trial was insufficient to support a deliberate ignorance charge. We hold that even if the district court erred in giving the instruction, the error was harmless and was harmless as a matter of law. We AFFIRM the judgment of the district court for that reason.
